Recent Changes on HIPAA as Outlined by NAID
President Obama passed the American Recovery and Revitalization Act of 2009 on February 17, 2009. This is referred to as ARRA, and has been summarized in a recent publication “white paper”, titled, “Recent Changes to HIPAA and the Impact on the Information Destruction Industry.” The changes that are outlined in NAID’s “white paper” are outlined as follows:
- The Creation of a new Class of Covered Entities
- States’ Attorneys General Now in Charge of Enforcement
- Fines are increased from $25,000 to $1,5000,000
- Fines are Mandatory for Information Disclosures involving “Willful Neglect”
- The Creation of the First Health Data Breach Notification Requirement
- HIPAA Regulations are Now Extended to Business Associates
- Covered Entities are Required to Evaluate and Revise All Business Associate Contracts
